§ 1. Introduction

  1. 1The present document specifies booking terms and conditions for Apartamenty Do Studzienki 65 and Apartamenty Olimpijskie in Gdańsk.
  2. Owners of apartments will be very grateful to you for observing these house rules intended to ensure peace and safety to all guests.

§ 2. Booking

In order to book an apartment, please use the booking system which is accessible via the website or contact our office by e-mail or phone 08.00 a.m.- 08.00 p.m.: Apartamenty Do Studzienki 65: Martyna, Phone: +48 693-262-871, E-mail: apartamentydostudzienki65@tps.pl; Apartamenty Olimpijskie: Kamil, Phone: 885 267 268 E-mail.: apartamentyolimpijskie@tps.pl. Information to be provided: duration of your stay, arrival and departure dates, the apartment chosen, contact information, the number of people to be accommodated in the apartment and the time of arrival.

§ 3. Arrival, keys, payment

  1. Apartments are rented on a 24-hour basis.
  2. The apartment rental duration is from 03:00 p.m. on the day of arrival until 11:00 a.m. on the day of departure.
  3. Check-in hours are 03:00p.m.-08:00 p.m. A late check-in option is available from 10:00 p.m. to 01:00 a.m. at an extra charge of PLN 50. In such an event, an earlier contact is required to confirm the option. 
  4. An overstay after 11:00 on the day of planned departure will be charged for as an extra day of stay.
  5. The date and time of arrival to the apartment should be confirmed by phone or e-mail to the staff responsible for bookings not later than one day before the arrival.
  6. If unable to arrive at the time agreed, the Tenant shall immediately notify the Apartments staff. In no notification is received from the Tenant, the Landlord reserves the right to cancel the booking.
  7. When checking in, the Guest receives a pre-programmed key-card and access codes to the facility entry gate and the drop box, unless these have been provided via e-mail or an SMS gateway, in advance.
  8. For the check-in procedure, an identity document is required to confirm personal data and receive the apartment access key card. In case of doubt  about the identity document, the staff member appointed to contact the guest  may request another ID document to confirm the identity of the person checking in.
  9. The payment for the stay occurs on the day of arrival at the latest.
  10. If the payment has not been made, the Guest will be refused to enter the apartment.
  11. TPS Sp z o o Sp.K. reserves the right to refuse accepting a Guest, without any refund, if the Guest:
    1. has no identity document or refuses to present an identity document
    2. is under the influence of alcohol or other intoxicants
    3. demonstrates vulgar behaviour towards the facility staff
    4. expresses unlawful threats or any form of blackmail
    5. refuses to pay for the stay or any of the mandatory charges.
  12. The guest should inform in advance the apartment staff of the wish to stay beyond the departure date specified on the day of arrival. The acceptance will depend on the availability of apartments. The extension can be subject to an extra charge.
  13. In addition, we bill the local fee of PLN 2.41/person/day charged by the City of Gdańsk.
  14. An agreed refundable security deposit can be charged on the day of arrival, in order to secure any damage or violations of these House Rules. The deposit will be refunded on the hand-over of the apartment to the reception desk staff, if no damages have been found.

§ 4. Booking cancellations and shortening stays

  1. Bookings via an e-mail, as well as online or phone bookings involve the payment of a deposit or a prepayment. The deposits or prepayments are non-refundable in the event of unexpected changes to our Guests’ plans.  TPS Sp z o o Sp.K.  may positively respond to a request to cancel a reservation or change its dates in some justifiable cases, provided that the cancellation or modification occurred not later than 7 days before the arrival. Otherwise, the deposit paid or the prepayment made shall be deemed to be a payment for the service provided.
  2. If the Guest is forced to check out earlier due to reasons beyond the control of TPS Sp z o o Sp K. – they will not be entitled to claim any refund for the remaining stay. Any refund is exclusively at the discretion of the Apartment Administrator and shall be handled on an individual basis.  The weather and weather conditions are in no way a reason for a refund when leaving early and leaving the apartment.

§ 5. Apartment rental services

  1. The rental price includes all taxes and utility charges, i.e. gas, electricity, water, wi-fi access and cleaning.
  2. Each apartment is fitted with one set of bedding and towels per person. A set consists of: a bed sheet, a pillow, a duvet, a bath towel, a hand towel, a floor towel.
  3. There is an option to order additional cleaning, a replacement of towels during your stay (to be charged as per the price list available at the reception desk). There are car parking spaces available on the premises, subject to an additional fee as per the price list. The facility staff shall not be held responsible for any damage to or loss of a vehicle owned by Guests or any property left inside the vehicle.

§ 6. Rights and responsibilities of Guests

  1. The tenant undertakes to use the subject of rental solely for accommodation purposes and shall not sublease it or make it available for free to any third parties.
  2. The apartment cannot accommodate more people than specified in the booking process.
  3. The Tenant shall keep the apartment in the same condition as at the beginning of their stay. It is not permitted to relocate any furniture or household appliances provided in the apartment.
  4. All and any deficiencies or defects should be reported by the Guest on the day of check-in.
  5. Failure to submit comments and objections (in writing: a text message, an e-mail, etc.) as to the technical condition of the apartment on the day of check-in means that the apartment, as well as the equipment in it, have been provided in a condition raising no comments or objections of the Guest.
  6. The Guest shall be fully responsible for any damages to the apartment or the equipment inside it, as well as to the common areas of the facility, including common areas of the building in which the apartment is located, as well as to apartments adjacent to the apartment, beyond normal wear and tear, caused by the Guest and by persons staying with them in the apartment.
  7. The Guest may use the apartment rented by him/her and use – on a non-exclusive basis – general use spaces and amenities, in accordance with their intended use.
  8. Common use amenities include a laundry with washing machines and dryers. The laundry is situated on level 1 of the building. Each Gueast may use the laundry, subject to the following rules: 
  9. The laundry can be used between 08.00 a.m.-08.00 p.m.
  10. The appliances are available for a charge, based on the price list specified by the Property Administrator. The payment is made each time via the machine in the laundry room
  11. When using the laundry, the Guest shall keep it clean and use the equipment according to its intended use
  12. The Guest is expected to follow the good neighbourliness principle, help keep the apartment, the staircases and the building areas clean and keep the apartment in a good condition.
  13. 10:00 p.m – 06:00 a.m. are the facility quiet hours – the Guests are kindly requested not to disturb others during these hours.
  14. Non-residents are allowed on the premises only between 07:00 a.m. – 10:00 p.m. 
  15. Smoking cigarettes and tobacco products is not permitted on the premises, unless in designated areas. A guest who has not followed this restriction and activated the smoke alarm, which resulted in an unauthorised arrival of the Fire Brigade, will be charged a fee of PLN 500.
  16. Apartment Guests rent the apartments and we as an operator can only be responsible for this aspect and guarantee the Guests’ stay as a rental service. Any and all events that do not occur inside the facility are not guaranteed by us and are beyond our control. Any sudden weather changes, accidents and other Force Majeure events which are not related to the rental and cannot be attributed to it in any way, are not claimable, refundable, etc.
  17. The Guests are kindly requested to check and lock the doors and shut the windows before leaving the apartment.
  18. A member of staff has the right to check the technical condition of the apartment – any faults noticed at that time and not reported to the receptionist will be charged to the account of the Guest when handing over the apartment on the day of departure.
  19. We do not offer any catering services on our premises – all our apartments are fitted with fully equipped kitchenettes.
  20. Subject to the TPS Sp z o o Sp.K. consent, the Guest may assign all his/her rights and responsibilities to a third person, on this condition however that this person accepts all of the rights and responsibilities provided for in the agreement signed.
  21. The tenant is responsible for the keys to the apartment, the access card and the remote garage opener (if any) and if any of these has been lost – the tenant shall pay the cost. A fee of PLN 100 is charged for the loss of or damage to the card.
  22.  Pets are allowed in the apartment only if TPS Sp z o o Sp K. have been notified of the fact and their consent has been received.
  23. The Guests are kindly requested to check and lock the doors and shut the windows before leaving the apartment.
  24.  No photographs or videos recorded in the apartment and showing the apartment equipment can be publicised, unless the Tenant’s written consent has been obtained in advance. This restriction applies in particular to photographs and videos publicised on web portals and in social media.
  25. The liability of the staff for any loss of or damage to any items brought by the Guest into the facility shall be governed by the provisions of Art. 846- 849 of the Polish Civil Code.
  26. The Guests using the Apartments shall follow these House Rules. The staff have the right to refuse to accept Guests who grossly violated these House Rules during their previous stay. Whenever any Guests behave in a manner violating the House Rules and disturb the peace of others (this applies to quiet hours in particular), the staff have both the right and responsibility to call in the security personnel or the Police. The Guests undertake to leave the premises immediately on request of the staff in the event of violation of any clause of the House Rules. It is not possible to claim a refund for the remaining stay in such a case.
  27. For those using online booking – booking a stay is equivalent to complying with the above House Rules.

§ 7. Force Majeure

  1. The landlord has the right to terminate the agreement due to a Force Majeure event. This also applies to cases, where the personal security of the Tenant or their property cannot be guaranteed for reasons beyond the Landlord’s control.
  2. In the circumstances specified in § 7.1, the amounts paid by the Tenant shall be paid back immediately , with a deduction of any amounts due to the Landlord for services that have already been provided.

§ 8 Complaints

  1. If any nonconformities occur, the Tenant has the right to place a complaint within 14 days of their occurrence. All complaints should be sent to apartamentydostudzienki65@tps.pl
  2. A complaint will be handled within 14 business days of the receipt. The response to the claim shall be sent to the Tenant via e-mail immediately.

§ 10. Final provision

Any disputes between the Landlord and the Tenant shall be governed by the Polish law. The disputes shall be resolved by the Court of Justice competent for the Landlord.
